DPP Withdraws Request to Drop Graft Case Against Ex-Samburu Governor Lenolkulal

Director of Public Prosecutions (DPP) Noordin Haji has withdrawn a request to drop a graft case against former Samburu Governor Moses Lenolkulal.

On Friday, Senior Assistant DPP Alexander Muteti informed the court that although they had initially submitted a request to have the case withdrawn, they had since decided to withdraw it following consultations with Haji.

According to Muteti, the proceedings should continue as originally planned.

The DPP’s application was approved by Magistrate Thomas Nzioki.

The case will move on to the hearing on January 23, 2023, during which the final witness is anticipated to testify.

The prosecution had on Wednesday sought to drop the Sh84 million graft case against the former county boss.

Lenolkukal had petitioned the DPP’s office for a reconsideration of the charges leveled against him and stating that he was taking the necessary measures to give up ownership of Oryx Service Station.

The former governor was in 2019 charged with four counts of abuse of office and conflict of interest that resulted in the loss of Sh84 million public cash.

He has been accused of supplying the county with super petrol and diesel through his business, the Oryx Service Station.

The charge sheet indicates Lenolkulal ‘knowingly acquired direct private interests in contracts between Oryx and Samburu for the supply of fuel”.

He is being charged alongside Hesbon Ndathi and nine others.

In his appeal, Lenolkulal asserted that correspondence from the Samburu County Treasury Department showed there were no procurement violations.
