DP Gachagua Wants Cases Against Falsely Accused Persons to be Dropped

Deputy President Rigathi Gachagua wants cases of falsely accused persons to be withdrawn.

Speaking on Sunday at ASK Show Ground in Baringo during a thanksgiving ceremony, the DP thanked the Directorate of Public Prosecutions (DPP) for dropping his graft case.

Earlier this week, the prosecution was allowed to drop a Sh7.3 billion corruption case against the former Mathira MP and nine others.

“Withdrawing my case is not enough, more cases should be dropped for all those who were accused falsely because it is a big mistake to fault someone based on their political affiliation,” he said.

The former MP further stated that he has since forgiven those who instigated the charges leveled against him in 2021.

He also asserted that the Kenya Kwanza government led by President William Ruto will abide by the rule of law.

“Those who arrested us, accused us of the cases, we have forgiven you. Even the one who sent them to arrest us and strip us naked in front of children we have forgiven you,” he said.

“Ruto’s government will not take that road and we have told the police that we shall never call them to go arrest someone because of their political stand.”

An anti-corruption court on Thursday allowed the withdrawal of the graft case under Section 87 for lack of evidence.

However, magistrate Victor Wakumile, warned the accused persons that they may be re-arrested in the future on the same charges.

He said that one cannot prefer charges while anticipating to gather evidence. He also faulted investigative bodies for arraigning suspects while still fishing for evidence.

“The decision to charge must be exercised partially and independently,” he said.

“Never should a judicial system be used as a doormat. There is a need to respect institutions.”

Magistrate Wakumile ordered that the Sh12 million bail deposited by the deputy president should be returned to him.

His passport, the court ordered, shall also be returned. The same shall apply to his co-accused.
