Court Finds MP Babu Owino Has Case to Answer in Firearm Misuse Case

A Nairobi court has determined that Embakasi East MP Babu Owino has a case to answer for the misuse of a gun.

In a ruling rendered by Milimani Senior Principal Magistrate Bernard Ochoi, the court called the MP’s defense for acting disorderly and having a gun in his possession.

On January 17, 2020, at the B Club in the Kilimani region,Babu is accused of shooting Felix Orinda, better known by his stage name DJ Evolve.

“After evaluating prosecution evidence and all the exhibits including CCTV footage, l find that the prosecution has proved a prima facie case against the accused person. I, therefore, find him with a case to answer and accordingly place him on his defence,” Ochoi ruled.

The MP will defend himself on June 15.

The MP was accused of misusing a firearm in a public place, with the prosecution calling more than ten witnesses to support their case.

State counsel told the court that the MP was a gun owner who misused his weapon while at B Club on January 17, 2020, urging the court to find the MP with a case to answer.

The prosecution informed the court in their submissions that the testimony of the State witness was strongly corroborated by the CCTV camera evidence.

Babu’s lawyer, Cliff Ombeta, argued that the prosecution had not proved their case beyond reasonable doubt.

The defense argued that the prosecution’s witnesses’ testimony and the CCTV footage presented in court were inconsistent.

Last year, DJ Evolve abandoned the lawsuit, claiming he had made amends and wished to focus on his recovery.

While approving the motion to drop the charges, Ochoi stated that despite the fact that the court was not involved in the negotiations, Owino was taking responsibility for the welfare of DJ Evolve, who had consented to a settlement outside of court.
