Blow to Kioni as Disputes Committee Dismisses Case

The dismissal of a complaint brought by the troubled Jubilee secretary general Jeremiah Kioni has dealt retired President Uhuru Kenyatta yet another setback.

In a decision issued on June 7, the Internal Dispute Resolution Committee (IDRC) confirmed that the calling of a National Executive Council (NEC) meeting by Nelson Dzuiya and Joshua Kutuny (respondents), did not violate the law.

“The Committee finds that the NEC committee held February 10 was convened in accordance with the provisions of the party Constitution,” the ruling reads.

“The respondents did not contravene provisions of the party Constitution in convening the meeting.”

In reaching its decision, the committee led by Gideon Solonka said that it had been convinced that the complainant (Kioni) had neglected to call a NEC meeting as instructed by the National Management Committee, which had prompted the respondents’ action.

According to the statement, the NMC has held four sessions since the general election on August 22 with the purpose of assessing the results and directing the members.

“The material placed before us reveals a systematic blatant disregard of the party Constitution by the complainant aimed at holding the party organs at ransom thus paralysing the activities of the party,” reads the ruling.

The Committee decided that by neglecting to call any NEC meetings, the complainant had violated his “fiduciary duty.”

On May 18, Kioni filed a case in an effort to have the decisions made during the NEC meeting ruled invalid.

The decision effectively ends Uhuru’s fight for the party he formed in 2017.

A faction led by EALA MP Kanini Kega has also called a Special NDC on July 22 at the Kenyatta International Conference Centre (KICC).
