DPP To Handle Moses Kuria, Sabina Chege’s Vote Rigging Cases – Chebukati

The Independent Electoral and Boundaries Commission (IEBC) has referred MPs Moses Kuria and Sabina Chege’s alleged vote rigging cases to the Directorate of Public Prosecutions (DPP).

Wafula Chebukati, the chairman of the electoral commission, on Friday said that the files of the Gatundu South lawmaker and the Murang’a Woman representative will be forwarded to DPP Noordin Haji for action.

He stated that the commission’s role in the cases had been found unconstitutional by the High Court.

In the run-up to the August 9 elections, Chebukati said the commission is prepared to strictly enforce the electoral code of conduct.

However, now that the court has revoked its authority, he stated that the commission would simply conduct a thorough investigation of the cases before collaborating with Haji’s office to get the accused persons tried in court.

Kuria and Chege have been charged with violating the commission’s rules of conduct by alleging election manipulation.

Kuria recently defended himself saying that his comments about allegedly assisting in the rigging of President Uhuru Kenyatta’s election were taken out of context.

“Mliimba ama mliiba?” he was asked. – Were you singing or stealing?

“You know we have all these linguistic challenges, but we didn’t choose where to come from. So all our ethnic influence, accent and all that can sometimes get lost in the translation,” Kuria said.

Last week, the Gatundu South lawmaker moved to court seeking orders barring the commission from hearing his case.

He argued that the process was started not to protect the sanctity of anything, but to shield the electoral board from public scrutiny after it failed to comply with Supreme Court instructions 5 years later.

Following charges of anomalies in the presidential petition before the Supreme Court, Kuria’s suit would force the commission to open the servers.

This order has yet to be complied with.

Kuria filed an urgent plea with the High Court in Milimani to have the ongoing proceedings against him halted.

An order mandating the panel to provide a report on the ostensibly conducted investigations was also sought.

He also wanted the court to order the commission to stop conducting any additional investigations into him on the same subject, as well as a statement that the IEBC’s summonses are unlawful.
