ODM to Hold Fresh Nominations for Westlands MP in Three Days

The nomination of Westlands MP Tim Wanyonyi has been revoked by the Political Parties Dispute Tribunal.

This comes after Michael Magero Gumo, the son of veteran politician Fred Gumo, filed a suit challenging ODM’s nomination decision.

Wanyonyi’s certificate has also been revoked by the Tribunal.

Magero maintained that he won the party primaries and that Wanyonyi did not participate in the process.

As a result, the Raila Odinga-led party has been given 72 hours to conduct fresh nominations.

Magero filed a lawsuit against the Orange Democratic Movement’s National Elections Board last week, requesting that the party not submit Wanyonyi’s name to the IEBC.

His lawyer, Duncan Okatch, claimed that he received 1,661 votes in the party primaries, while his closest competitor, former City Clerk Phillip Kisia, received 627 votes.

He mentioned that he spent millions of shillings to rally support for his campaign in the Westlands Constituency and thus deserves to be given the party ticket.

“I spent a lot of resources and time to marshal support for my bid. The results were publicly announced thus giving me the legitimate expectation that I would be issued with the certificate,” Magero argued.

The complainant stated in court papers that attempts to contact party officials had been fruitless.

He demanded that ODM hand him the nomination certificate, claiming that incumbent Wanyonyi did not participate in the primaries.

He also sought an injunction compelling the party and its Returning Officer to put his name on the list of party nominees for the Westlands Constituency flagbearer.

Despite his client’s victory in the primaries, Okatch told the Board, he has yet to get the Interim Certificate, and the party has remained silent.

He expressed concern that Wanyonyi will be awarded the certificate following a meeting of Azimio leaders when it was decided to give him a direct ticket to defend his seat.

Magero claimed that no legal process authorizes ODM to award a certificate to someone who did not participate in the nominating process.

He asked the NEB to issue a temporary restraining order to prevent Wanyonyi’s name from being gazetted.

He is also asking for a permanent injunction barring ODM from submitting any other person’s name to the IEBC.
