Parliamentary Committee Adjourns Petitions against IEBC Four to Tuesday

The Justice and Legal Affairs Committee (JLAC) has adjourned hearings on petitions seeking the ouster of four IEBC commissioners.

Committee chair George Gitonga said the sittings will resume on Tuesday to allow IEBC vice chair Juliana Cherera time to file her response.

Mr Gitonga said this will ensure the exercise is free and fair.

“This committee is inclined to grant adjournment however it is not along the terms asked for but according to terms considered as fair by the Committee,” Gitonga said.

“Hearing of this matter will proceed tomorrow November 29 from 8 am.”

Through lawyer Apollo Mboya, Cherera had sought to have the hearings suspended for 10 days.

Her advocate had cited Article 50 of the Constitution on fair hearing.

Cherera earlier urged that the committee meeting be called to order due to President William Ruto’s Friday tweet labeling the four commissioners as rogue.

Ruto’s post, according to Mboya, was damaging to her and seemed to suggest a predetermined outcome.

“We need better particulars. The tribunal will be formed by a person who has referred to the Commissioners as rogue,” Mboya said.

“We seek the House to adjourn to obtain particulars from His Excellency the President. The petitioners however opposed the adjournment call claiming the lawyer is playing delaying tactics.”

Earlier, demonstrators protested outside County Hall where JLAC was meeting to receive submissions from Cherera.

Led by the President of Bunge la Mwananchi, Calvin Okoth Otieno, the protestors vowed to hold daily demonstrations in solidarity with Cherera and commissioners Irene Masit, Francis Wanderi and Justus Nyang’aya.

“Kenyans are with Cherera and the three others. Even if they throw tear gas or fire live bullets at us, we will not stop,” Otieno stated.
