Mau Mau Fighters in Court Seeking DP Ruto’s Removal from Office

A section of Mau Mau fighters from Central Kenya have moved to court seeking the removal from office of Deputy President William Ruto.

The leaders, led by Michael Kurungia, accused DP Ruto of failing to fulfill his responsibilities as the country’s second-in-command.

Kurungia also accused DP Ruto of gross misconduct on grounds that he was criticizing the administration in which he serves. The matter has been filed under urgency.

“The Deputy President William Ruto has failed to perform the functions conferred to him by the Constitution,” Kurungia says in court documents.

They also accused the UDA presidential candidate of misusing public funds and resources during his campaign for the August 9 elections.

According to Kurungia, the DP has been carrying out several responsibilities in violation of the pledge he signed before taking office.

The Mau Mau fighters want the court to find Ruto guilty of a crime under Kenyan law’s Oaths and Statutory Declaration Act, chapter 15(ii).

Ruto, according to the group, has violated Article 147(1) (2) of the Constitution by not acting as the president’s principal assistant and instead performing his own duties.

“Unless the orders sought are granted, the public is going to suffer irreparable loss and damage,” court documents read.

Kurungia is also seeking to prevent the DP from holding United Democratic Alliance (UDA) meetings in his office or at his house until the issue is heard and decided.

The matter will be heard on April 28.

In January, activist Okiya Omtatah moved to court seeking orders forcing Dr Ruto vacates office ahead of the polls.

In the petition, Omtatah said that any public officer, including a sitting deputy president, a sitting governor, a sitting deputy governor, a sitting MP, and a sitting MCA must vacate office before nomination as a presidential candidate.

“A declaration that a sitting president, a sitting deputy president, a sitting governor, and a sitting deputy governor cannot be elected to elective positions other than the ones they hold,” he said.

“That a declaration that any public officer, including a sitting deputy president, a sitting governor, a sitting deputy governor, a sitting MP, and a sitting MCA is not qualified for nomination as a presidential candidate.”

The activist asked that a declaration be issued stating that a sitting president, a sitting deputy president, a sitting governor, and a sitting deputy governor must vacate office before they can be elected to elective positions other than the ones they hold.
