CS Tuya Sues Ex-husband for Sh525,000 in Child Upkeep

Environment Cabinet Secretary Soipan Tuya has sued her estranged husband, Stephen Kudate, to court citing physical and emotional abuse.

In court documents seen by The Political Press, the former Narok MP has asked the court to grant her full custody of their two children.

Through Daniel Ondabu and Company Advocates, Tuya has filed a protection order for her, her children, and her domestic workers against Kudate.

“The Respondent relentlessly treats the Plaintiff/Applicant, their children, and the applicant’s domestic workers with cruelty and has been psychologically, emotionally, and verbally abusive,” she said.

“Owing to the abusive and erratic nature of the Respondent, the Plaintiff/Applicant, their children, and the applicant’s domestic workers have been living in mortal fear for their lives.”

Tuya wants her ex-husband to pay Sh225,000, which is half the amount of the school fees for the minors.

She also wants the defendant compelled to pay Sh100,000, for the children’s monthly entertainment. The CS wants an additional Sh100,000 to cater for maintenance.

Tuya also wants the court to issue a restraining order against Kudate.
 
“That the Court be pleased to issue a permanent injunction directed to and restraining the Defendant herein either by himself, his servants or agents from abusing the plaintiff and their children physically, emotionally, verbally or insulting, ridiculing and issuing threats of whatever nature by any means to the plaintiff and their children…” she adds.

The minister told the court that her husband has continued to neglect his responsibilities towards the children and has been unfaithful.

She claims to be the sole breadwinner, providing all of the children’s basic needs including food, shelter, education, and clothing.

“The defendant has instead adopted a very casual approach to the financial needs of the children, contributing nothing to school fees, clothing, and other basic needs.”

Tuya says that she and the defendant ended their relationship in October 2020.
