Maina Njenga Wants DP Gachagua Summoned Over Contempt of Court

Former Mungiki leader Maina Njenga wants Deputy President Rigathi Gachagua summoned over contempt claims.

He accused Gachagua of speaking out in public about a case in which he is suspected of being a part of an organized criminal group, among other things.

“This court has a duty to protect the sanctity of trial and proceedings before it. It is prohibited, under the general rule of law, comments that amount to sub judice. The facts of the case ought not to be discussed in any fora than the court,” court documents read.

Njenga requested that Gachagua be called before the court, claiming that since the case was still pending, the remarks he had made about him constituted contempt.

“This attracts the punishment by the court where so is established. In this case, I have been asked to call upon to summon the person in the name and form of Deputy President, Republic of Kenya, who is accused of making comments amounting to sub judice,” the judge said.

However, the court rejected Njenga’s requests because it was unconvinced that there had actually been a violation.

“No material has been placed before me to demonstrate the asserted contempt by the deputy president,” the court said.

Njenga is accused of addressing a crowd on May 11, 2023, in Wanyororo, Nakuru County with a view of encouraging support for the Mungiki sect.

He is also accused of participating in criminal activity.

Additionally, he is charged with having “a military backpack strap, property of the National Police Service (NPS) that is suspected to have been stolen or unlawfully obtained.”
