Mathe wa Ngara Moves to Court to Block Arrest

Businesswoman Nancy Kigunzu, also known as “Mathe wa Ngara,” has filed a lawsuit in an effort to avoid being arrested.

According to court documents, Kigunzu describes herself as an upstanding citizen who has never broken the law in Kenya. She also claims that she has never been arrested or charged with a crime.

She also asserts that she is being pursued by police on fabricated allegations and that they are using her as a scapegoat.

“The applicant is of the firm belief that the timing of the arrest is designed to intimidate and ensure that she does not continue running her business here in Kenya,” court papers show.

Kigunzu further asserted that the Directorate of Criminal Investigations (DCI) and Inspector General of Police Japhet Koome are threatening to arrest her and that they are doing so in violation of her constitutional rights.

“The powers of arrest by the 1st (DCI) and 2nd (IG Koome) respondents are being abused and misused to harass, intimidate and oppress the applicant,” she said.

She continued by saying she was ready to use “a just and fair legal system in which her fundamental rights are respected.”

Kigunzu consequently requests anticipatory bail or bond and an injunction to be granted protecting her from arrest.

On August 17, four suspects were detained after a drug bust at Kariwa slums in Ngara turned up hidden notes worth Ksh.12,975,000, 26 bags of marijuana, and four cartons of rolling equipment.

173 suspected pieces of a drug/bhang blend and 42 cartons, each holding 200 cigarettes, were also seized.

Eugene (16) and Hillary (17) Jumba, two of Kigunzu’s children, were among the suspects who had been detained. Others are; Sheila Withers and Teresa Wanjiru.

There was a protracted manhunt for Kigunzu after it was discovered Teresa Wanjiru, who was initially believed to be the real “Mathe wa Ngara,” was not the person of interest.
