Alfred Mutua Threatens Legal Action Against Parties Registrar Over Azimio Coalition Agreement

Machakos County Governor and Maendeleo Chap Chap party leader Alfred Mutua has accused the registrar of political parties and the Azimio la Umoja One Kenya Coalition party of denying his party a copy of the Azimio coalition agreement, which was signed by over 26 political parties.

“The registrar of political parties (ORPP) and Azimio coalition party have refused to give us a copy of the Azimio coalition agreement deposited with the ORPP we signed to form the coalition,” lamented the outgoing county boss via Twitter.

The county chief stated that his party will move to court to demand a copy of the document in contention.

The governor questioned why members of the Azimio coalition party had to go to court to obtain a document that binds them to other political parties.

“It is unfortunate that we are in a coalition relationship whose members have to go to court to get what is their automatic right. What games are they playing?” he wondered.

Members of the Maendeleo Chap Chap party will gather and debate on the next steps, he said.

He also stated that his party will investigate their partners’ alleged underhanded plans to zone out their party aspirants.

Mutua stated that his party will not accept ideas that will deny aspirants in Azimio parties the democratic right to run for elective posts.

Last week, ORPP CEO Anne Nderitu rejected an attempt by Maendeleo Chap Chap and Kilifi Governor Amason Kingi’s Pamoja African Alliance (PAA) to leave the President Uhuru Kenyatta and Raila Odinga-led movement.

In a letter to PAA, Nderitu stated that her office did not have the authority to degazette the party unless it follows the proper procedures.

“Azimio is already a registered coalition political party in terms of section 7(7) of the Political Parties Act (Registration), Regulations 2019,” she said.

“Hence the registrar has no mandate to degazette PAA as per your request save for where due process outlined in the coalition agreement has been followed.”

PAA had met all of the prerequisites and presented all of the required paperwork, according to the registrar, demonstrating its commitment to the alliance.

“That PAA, as one of the constituent parties, duly executed the coalition agreement annexing the requisite documents including former PP19 declaring that the information submitted is true and correct,” Nderitu added.

Nderitu likewise denied to accept the request in response to MCC, citing similar reasons.

“MCC party, as a constitutional political party, executed the coalition agreement annexing the requisite documents including form pp19 declaring that the information submitted is true and correct,” she stated.

“By operation of the vacancy in the office of the chairperson, the two authorised signatories duly signed the coalition agreement and Azimio is already a registered coalition political party in terms of section 7 (7) of the political parties act 2011 and the political parties regulations 2019. Hence the registrar has no mandate to sanction the withdrawal as per your request save for where the process outlined in the coalition agreement has been followed.”
