Omtatah Warns EPRA Against Disregarding Court Order on Finance Act

The Energy and Petroleum Regulatory Authority (EPRA) has received a warning from Busia Senator Okiya Omtatah not to disobey court decisions regarding Finance Act 2023.

This comes after a petition filed by Omtatah and others forced the High Court to halt the implementation of the Finance Act.

The lawmaker stated that he will pursue any person, group, or organization that disobeys the order.

“The second order, the court says thou shall not do anything about that bill to impose it on Kenyans,” Omtatah said.

“That will be an order EPRA needs to take seriously because if they don’t we shall be after them.”

The Authority, he claimed, is well aware of the issued order and should not take any actions that might violate it.

“They have ample knowledge that the court has issued orders, it’s in the media and all over. It will not have any defence against that order. So I hope that EPRA will obey that order,” Omtatah said.

Omtatah had filed a lawsuit asking for the implementation to be stopped, claiming the Act is unconstitutional.

In order to safeguard the interests of counties and their governments, he said, the Finance Act amends a number of laws without regard to revenue-raising and laws that have an impact on the Senate’s function.

However, EPRA has already revised fuel prices. In Nairobi, Kerosene prices went up by Sh11.96, Diesel by Sh12.39, and Petrol by 13.49.

Peter Agoro submitted the second appeal to halt the execution of the Finance Act, claiming that the Finance Bill 2023 was based on illegality and hence infringed upon and violated the Constitution.

The matter will be mentioned on July 5.
