An Employment and Labour Relations court has awarded former digital, innovative, and diaspora communication director Dennis Itumbi Sh630,000 over unfair sacking by State House.
Justice Jacob Gakeri found that even though the government was justified to sack him, it did not act in accordance with the Employment act.
The court also found that Itumbi worked for the retired President Uhuru Kenyatta-led administration for five years, eight months and was willing to stay on until October 2022.
Itumbi, the court said, was not issued either a warning or disciplinary letter.

“The respondents may have had a valid and fair reason to terminate the petitioner’s employment but did not comply with the requirements of the provisions of the Employment Act, 2007, to guarantee procedural fairness in the process,” said Justice Gikeri.
He was employed on July 9, 2014 and was let go in March 2020.
Itumbi received word that his unemployment had been ended due to the abolition of the office as a result of reorganization.
He, however, moved to court claiming that he was fired by an unauthorized personnel.

The complainant who is currently working with President William Ruto’s government, said that the Public Service Commission let him go on the order of the former Interior Cabinet Secretary, Dr Fred Matiang’i.
He claimed that there was no basis for the PSC to work with the CS to abolish his position.
PSC argued against the lawsuit in its reply.
It claimed that on June 5, 2014, State House attempted to create an additional job for Itumbi that would fall under the purview of the President’s Delivery Unit (PDU) and State House comptroller.
